Terms and conditions

These terms apply to kayleehottle.com, kbhforever.com and the kbh forever shop (together, the “Site”), run by KBHLEGACY LLC, a Texas limited liability company (“we,” “us,” “our”). By using the Site or placing an order, you agree to these terms and to our Shop Policies (shipping, pre-orders, returns, sales tax and privacy), which are part of these terms. If you do not agree, please do not use the Site.

1. Who can buy

You must be at least 18, or have a parent or guardian’s permission, to place an order. You agree that the information you give us is true and complete, and that you are allowed to use the payment card you provide. We currently ship only to addresses in the United States.

2. Products and descriptions

We try to show our shirts, decals and other items as accurately as we can. Colors can look different on different screens, and sizes and fit can vary slightly between items. Photos are for illustration. Stock counts on the Site update often but may not be exact at every moment.

3. Prices and errors

Prices are in U.S. dollars and are shown on the Site. Shipping and any sales tax are shown at checkout before you pay. We may change prices at any time, but a change will not affect an order we have already accepted. If an item is listed at a clearly wrong price or with wrong information because of an error, we may cancel the order and refund you in full, even after you have paid.

4. Orders

• Your order is an offer to buy. We accept it when we ship it, or when we confirm it in writing (including by email). The receipt you get after paying confirms we received your order and payment.
• We may limit quantities, or decline or cancel any order, for example if an item can’t be made, if we suspect fraud, or if there is a pricing error. If we cancel, we refund what you paid for the cancelled items.
• All orders are final once placed. The only exception is a pre-order that will ship later than promised: we will email you a new date, and you may cancel that pre-order for a full refund, as described in our pre-order policy.

5. Payment

Payments are processed by Square. Your card details go directly to Square and are handled under Square’s own terms and privacy policy. We never see or store your full card number. You authorize us to charge the total shown at checkout.

6. Shipping, title and risk of loss

In-stock items ship within 5 business days of your order. Delivery times after that depend on the carrier and are not guaranteed. Ownership of the items and the risk of loss pass to you when we hand the package to the carrier. If a package is lost or arrives damaged, write to us and we will work with you and the carrier to make it right.

7. All sales final

All sales are final. We do not accept returns or exchanges. If an item arrives damaged or is not what you ordered, write to us within 14 days of delivery and we will replace or refund it, as described in our policies. Nothing in this section limits any rights you have by law.

8. Kaylee’s name, the kbh mark and site content

This Site honors the memory of Kaylee B. Hottle. Her name, image and story, the “kbh” monogram and logos, product designs, photos and text on the Site are owned by KBHLEGACY LLC or used with permission. Buying a product gives you the right to use and enjoy that product. It does not give you any right to copy, reproduce, sell or make products using these names, marks, designs or images. You may share links to the Site and personal photos of items you bought.

9. Using the Site

Please don’t misuse the Site. That includes trying to break or overload it, getting into parts you aren’t meant to, using bots to buy up stock, using someone else’s payment card, or using the Site for anything illegal or hurtful to others.

10. Disclaimer

The Site and products are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties not expressly stated in these terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing in these terms limits any rights you have under consumer protection laws that cannot be waived.

11. Limit of liability

To the fullest extent the law allows, KBHLEGACY LLC and its members, volunteers and partners will not be liable for any indirect, incidental, special or consequential damages arising from the Site or any product. Our total liability for any claim about an order is limited to the amount you paid for that order.

12. Indemnity

If you break these terms or the law while using the Site, and that leads to a claim against us, you agree to cover our reasonable costs from that claim, including reasonable legal fees.

13. Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Travis County, Texas, unless the law where you live requires otherwise. Before starting any formal dispute, please write to us at the address below so we can try to resolve it.

14. Changes to these terms

We may update these terms from time to time. The date at the top shows when they last changed. The terms in effect when you place an order apply to that order.
